Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully before using the PAKKA service. By signing up for or using PAKKA, you agree to be bound by these Terms. If you do not agree, do not use the service.

1. About PAKKA

PAKKA is a software service that enables merchants to send automated WhatsApp order confirmation messages to customers who have placed Cash on Delivery (COD) orders on their Shopify store. The service is built on the official Meta WhatsApp Business Cloud API. PAKKA is operated by Akash Murugan (sole proprietorship), trading as PAKKA, at 14-1-115(2), Anna Nagar, Surandai, Tamil Nadu 627859, India.

2. Eligibility

To use PAKKA, you must:

  • Be at least 18 years of age;
  • Be a business owner or authorised representative of a legally operating business;
  • Operate a Shopify store (or another supported platform) that offers COD as a payment method;
  • Agree to comply with all applicable laws, including Indian law and WhatsApp's Business Policy and Commerce Policy.

3. Service Description

PAKKA provides the following core functionality:

  • Detection of new COD orders placed on a merchant's Shopify store via Shopify webhooks;
  • Sending a WhatsApp template message to the customer's phone number via the Meta WhatsApp Business Cloud API, requesting order confirmation or cancellation;
  • Reading the customer's reply and automatically updating the order status in the merchant's Shopify store accordingly.

PAKKA is an independent software product. It is not affiliated with, endorsed by, or a certified partner of Meta Platforms, Inc. or Shopify Inc.

4. Merchant Responsibilities

As a merchant using PAKKA, you agree to:

  • Obtain customer consent: Ensure that your end customers have given valid, informed consent to receive WhatsApp messages from you (via PAKKA) regarding their orders, in accordance with WhatsApp's Business Policy and applicable Indian law (including the Digital Personal Data Protection Act, 2023).
  • Comply with WhatsApp policies: Use PAKKA only in ways that comply with Meta's WhatsApp Business Policy, WhatsApp Commerce Policy, and Meta's Terms of Service, as updated from time to time.
  • Use approved templates: Send only pre-approved WhatsApp message templates for order confirmation purposes. Do not attempt to use PAKKA for bulk promotional messaging or any purpose outside order confirmation.
  • Maintain accurate data: Ensure the phone numbers you submit through your Shopify store for WhatsApp messaging are accurate and belong to your customers.
  • Comply with applicable law: Use the service in compliance with all applicable Indian laws, regulations, and any other jurisdiction's laws that may apply to your business.
  • Account security: Maintain the confidentiality of your PAKKA account credentials and notify us immediately of any unauthorised use.

5. Acceptable Use

You must not use PAKKA to:

  • Send unsolicited messages, spam, or promotional content outside the scope of COD order confirmation;
  • Violate any WhatsApp Business Policy or Commerce Policy;
  • Harass, threaten, or harm any individual;
  • Transmit unlawful, fraudulent, or deceptive content;
  • Circumvent or attempt to circumvent any technical or security measure;
  • Reverse engineer, copy, or reproduce any part of the PAKKA software;
  • Use the service in any way that causes damage to PAKKA, Meta, Shopify, or any third party.

We reserve the right to suspend or terminate your account immediately if you violate this section.

6. Fees and Billing

PAKKA may charge fees for use of the service, which may be structured as a subscription, per-message credits, or other billing models as communicated to you at the time of sign-up. Details of applicable fees will be provided before you are charged. All fees are in Indian Rupees (INR) unless otherwise stated. Fees are non-refundable except as described in our Refund Policy. We reserve the right to change our fees upon 30 days' notice.

7. Intellectual Property

All intellectual property in the PAKKA service — including but not limited to software, design, trademarks, logos, and content — is owned by Akash Murugan (operating as PAKKA). You are granted a limited, non-exclusive, non-transferable licence to use the service for your own business purposes. You may not reproduce, distribute, or create derivative works of the PAKKA service or its content without our prior written consent.

8. Disclaimer of Warranties

PAKKA is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that WhatsApp messages will always be delivered successfully (delivery depends on Meta's infrastructure and the customer's device).

9. Limitation of Liability

To the maximum extent permitted by applicable law, PAKKA (Akash Murugan) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to loss of revenue, RTO losses, or business interruption — even if we have been advised of the possibility of such damages. Our total cumulative liability to you for any claim arising out of or related to these Terms or the service shall not exceed the total fees you paid to PAKKA in the three months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Akash Murugan (PAKKA), its affiliates, and their respective officers and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any third-party rights including WhatsApp policies; or (d) any content or data you submit through the service.

11. Termination

Either party may terminate use of the service at any time. You may stop using PAKKA and request account deletion by emailing hello@pakkaapp.app. We may suspend or terminate your access immediately and without notice if you breach these Terms, violate WhatsApp's policies, or if required by law. Upon termination, your licence to use PAKKA ceases and we will handle your data in accordance with our Privacy Policy.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising from or in connection with these Terms or the use of PAKKA shall be subject to the exclusive jurisdiction of the courts at Tirunelveli, Tamil Nadu, India. Before initiating any legal proceedings, the parties agree to attempt to resolve disputes through good-faith negotiation.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. If changes are material, we will notify active merchants by email at least 7 days before the changes take effect. Continued use of PAKKA after the effective date of the updated Terms constitutes your acceptance.
